Independent Pension Trustees

Our pension trustee services see us act as chair of trustees, corporate sole trustee, co-trustee, subcommittee chair or member, master trust trustee, IGC member or for ad-hoc support.

We maintain strict independence from scheme advisers, enabling objective oversight and robust challenge when needed.

Our collaborative approach means that clients benefit from both a dedicated lead trustee and a peer trustee. The peer trustee performs a quality assurance role, maintaining a level of knowledge of the scheme through regular discussions with the lead trustee and addresses “key person risk” exposure.

Pension Trustee FAQs :

A pension trustee is legally responsible for running an occupational pension scheme in the best interests of its members. Their duties include overseeing scheme investments, ensuring benefits are paid correctly, monitoring advisers, maintaining legal compliance, and communicating with members. Trustees must act independently of the employer and put members' interests first at all times.

An independent professional pension trustee is a specialist appointed externally, rather than drawn from the employer or the membership, who brings dedicated expertise to the trustee board. They are free from the conflicts of interest that can arise for employer-appointed or member-nominated trustees, and they provide continuity and experience that lay trustees may not be able to offer. At LawDeb, our trustees have backgrounds spanning actuarial, legal, investment, administration and governance disciplines.

There is no blanket legal requirement, but The Pensions Regulator increasingly expects trustees to demonstrate knowledge, experience and strong governance. In practice, independent trustees are appointed when: the trustee board lacks a specific skill set (for example, around risk transfer or investment); there is a conflict of interest, such as during a corporate restructuring; a trustee board wants a chair or co-trustee with deep pensions expertise; or the scheme is moving towards buyout or wind-up and needs specialist support throughout.

An independent pension trustee can serve in several capacities depending on what the scheme needs: Chair of trustees — leading the board and ensuring effective governance; Co-trustee — sitting alongside member-nominated and employer-appointed trustees; Corporate sole trustee (CST) — acting as the sole legal trustee in place of a full board; Subcommittee chair or member — leading investment, administration or other subcommittees; Master trust trustee or IGC member — for DC and workplace pension arrangements.

Yes. We support schemes of all types including defined benefit, defined contribution, hybrid, master trust and Independent Governance Committees. Our DC capabilities include trusteeship and governance for trust-based DC arrangements, master trust appointments, member engagement, investment default design and oversight, and support with DC consolidation decisions. We act as independent trustee for some of the largest private sector DC trust-based schemes in the UK.

Reaching endgame is one of the most complex and consequential periods in a scheme's life. Our team provides end-to-end support, from initial endgame planning and funding strategy through to insurer selection, data cleansing, benefit specification and transaction execution. We have significant risk transfer experience, with over £2 billion transacted in a single quarter, and can act as trustee, governance adviser, or project manager depending on what the scheme needs.
